City of Quincy City Council met April 20.

Here is the minutes provided by the council:

Due to COVID-19, President Donald Trump declared a national emergency on March 13, 2020, and Governor Pritzker issued an Executive Order on March 20, 2020.

Mayor Kyle A. Moore announced that all City buildings will be closed to the public on March 17, 2020.

The following minutes reflect those Aldermen who were virtually present.

The regular meeting of the City Council was held this day at 7:00 p.m. with Mayor Kyle A. Moore presiding.

The following members were physically present:

Ald. McKiernan, Entrup, Bergman, Bauer, Finney, Rein, Reis. 7.

Virtual: Ald. Ernst, Farha, Sassen, Mast, Awerkamp, Uzelac, Holtschlag. 7.

The minutes of the regular meeting of the City Council held April 13, 2020, were approved as printed on a motion of Ald. Bauer. Motion carried.

Legal Counsel: Assistant Corporation Counsel Bruce Alford.

The Deputy City Clerk presented and read the following:

PROCLAMATION

By Kyle A. Moore proclaiming April 24, 2020 as “Arbor Day.”

Ald. Holtschlag moved the proclamation be received and filed. Motion carried.

COUNCIL RESOLUTION AUTHORIZING SUBMISSION AND SUPPORT FOR SECOND STRING

MUSIC’S DOWNSTATE SMALL BUSINESS STABILIZATION GRANT APPLICATION

WHEREAS, the City of Quincy is applying to the State of Illinois for a Community Development Block Grant Program grant, and

WHEREAS, it is necessary that an application be made, and agreements entered with the State of Illinois.

NOW, THEREFORE, BE IT RESOLVED as follows:

1) that the City of Quincy apply for a grant under the terms and conditions of the State of Illinois and shall enter in to and agree to the understandings and assurances contained in said application.

2) that the Mayor and City Clerk on behalf of the City Council execute such documents and all other documents necessary for the carrying out of said application.

3) that the Mayor and City Clerk are authorized to provide such additional information as may be required to accomplish the obtaining of such grant.

This Resolution shall be in full force and effect from and after its passage, as provided by law.

PASSED and APPROVED this 21st day of April, 2020.

Ald. Uzelac moved for the adoption of the resolution, seconded by Ald. Holtschlag, and on the roll call the following vote resulted. Yeas: Ald. Farha, Sassen, Mast, Reis, Awerkamp, Uzelac, Holtschlag, McKiernan, Entrup, Bergman, Bauer, Finney. 12. Nays: Ald. Ernst, Rein. 2. Motion carried.

WHEREAS, the City of Quincy is applying to the State of Illinois for a Community Development Block Grant Program grant, and

WHEREAS, it is necessary that an application be made, and agreements entered with the State of Illinois.

NOW, THEREFORE, BE IT RESOLVED as follows:

1) that the City of Quincy apply for a grant under the terms and conditions of the State of Illinois and shall enter in to and agree to the understandings and assurances contained in said application.

2) that the Mayor and City Clerk on behalf of the City Council execute such documents and all other documents necessary for the carrying out of said application.

3) that the Mayor and City Clerk are authorized to provide such additional information as may be required to accomplish the obtaining of such grant.

WHEREAS, it is necessary that an application be made, and agreements entered with the State of Illinois.

NOW, THEREFORE, BE IT RESOLVED as follows:

1) that the City of Quincy apply for a grant under the terms and conditions of the State of Illinois and shall enter in to and agree to the understandings and assurances contained in said application.

2) that the Mayor and City Clerk on behalf of the City Council execute such documents and all other documents necessary for the carrying out of said application.

Ald. Finney moved for the adoption of the resolutions of Quincy Audiology, LLC., V.W. Fundraising, Domestics, Etc., Expressions By Christine Inc., seconded by Ald. Holtschlag, and on the roll call the following vote resulted. Yeas: Ald. Reis, Awerkamp, Uzelac, Holtschlag, McKiernan, Entrup, Bergman, Bauer, Finney, Farha, Sassen, Mast. 12. Nays: Ald. Ernst, Rein. 2. Motion carried.

RESOLUTION

WHEREAS, based on law, court decisions and case law, and developed best industry practices, law enforcement policies are ever evolving; and

WHEREAS, due to circumstances beyond our control, the police department is struggling to meet requirements of keeping policies up to date; and

WHEREAS, with policy failure comes liability; and

WHEREAS, Municipal Insurance Cooperative Agency (MICA) recommends we use policy management provider Lexipol; and

WHEREAS, Lexipol provides comprehensive, defensible policies written by legal and public safety professionals; and

WHEREAS, Lexipol provides a reduced rate for agencies belonging to MICA; and

WHEREAS, Lexipol has an annual subscription fee of $12,000; now

THEREFORE BE IT RESOLVED, the Chief of Police and the Police Aldermanic Committee recommend to the Mayor and City Council that we purchase service in the amount of $12,000 from Lexipol LLC., Irvine, CA 92606.

Ald. Rein moved for the adoption of the resolution, seconded by Ald. Sassen, and on the roll call each of the 14 voted yea. Motion carried.

RESOLUTION

WHEREAS, a violation of the municipal code is a lesser offense than a violation of state law, which could amount to a class A misdemeanor or felony charge

WHEREAS, the City of Quincy Police Department is obligated to enforce the laws of Illinois and Gubernatorial Executive Orders within city boundaries;

WHEREAS, the citizens of Quincy are both concerned about the spread of the Coronavirus and have overwhelmingly complied with the Governor’s Executive Order and shown strong support for our police in responding to the few complaints that have arisen against those in non-compliance

WHEREAS, the City Council approved an ordinance on April 6, 2020, at the request of the Chief of Police and Mayor to allow his officers to issue citations for repeated violations of the Governor’s Executive Order;

WHEREAS, no citations have been issued to date and citations will only be issued in the event the current three-step process of education, warning, and cease and desist has failed to bring the subject of a complaint into compliance with the Governor’s Executive Order;

WHEREAS, said ordinance will sunset when the Governor’s Executive Order expires;

THEREFORE BE IT RESOLVED, that the Council affirms their action on said ordinance.

Ald. Bergman moved for the adoption of the resolution, seconded by Ald. McKiernan, and on the roll call the following vote resulted. Yeas: Ald. Holtschlag, McKiernan, Entrup, Bergman, Bauer, Finney, Ernst, Farha, Sassen, Mast, Reis, Awerkamp, Uzelac. 13. Nay: Ald. Rein. 1. Motion carried.

ORDINANCE

Adoption Of The Ordinance Entitled: An Ordinance Amending The 2019 – 2020 Fiscal Year Budget. (Increase Expense: Health Insurance Claims $100,000.) Was up for adoption and tabled for one week by Ald. Ernst. Ald. Ernst moved to amend the ordinance amount from $100,000 to $607,000, seconded by Ald. Holtschlag. Motion carried.

Ald. Ernst moved the adoption of the ordinance as amended, seconded by Ald. Finney and on a roll call each of the 14 Aldermen voted yea.

The Chair, Mayor Kyle A. Moore, declared the motion carried and the ordinance adopted.

ORDINANCE

Second presentation of an ordinance entitled: An Ordinance Amending The 2019-2020 Fiscal Year Budget. (Increased Expenses $500,000 for the Small Business Emergency Loan Fund #706.)

ORDINANCE

Second presentation of an ordinance entitled: An Ordinance Adopting The Annual Operating Budget For The City Of Quincy, Illinois, For The Fiscal Year Ending April 30, 2021.

Ald. Rein moved to amend line item 502 from $11,507 to $11,281, seconded by Finney. Motion carried.

Ald. Reis seconded by Ald. Holtschlag, moved the reports be received and vouchers be issued for the various amounts and on the roll call each of the 14 Aldermen voted yea. Motion carried.

WRITTEN REQUEST TO SPEAK

Written request to speak by Danny Holstein, 630 Chestnut, concerning a sewer issue.

The Deputy Clerk read a summary of the written request to speak. A copy of the written request to speak was emailed to the City Council prior to the meeting.

MOTIONS

Ald. Bauer moved to allow a dumpster on city right-of-way at 1605 Elm starting on April 22nd for 30 days. Motion carried.

Ald. Uzelac moved to allow a road closure by Keck Heating & Air at 5th St., Broadway to Vermont, on Monday, April 27th, all day, to do work at the Salvation Army/Kroc Center. Barricades requested. Motion carried.

Ald. Holtschlag moved to have a handicapped sign placed at 814 S. 7th. Motion carried.

The City Council adjourned at 7:59 p.m. on a motion of Ald. Reis. Motion carried.
