City of Quincy City Council met July 2.

Here is the minutes provided by the Council:

The regular meeting of the City Council was held this day at 7:00 p.m. with Mayor Kyle A. Moore presiding.

The following members were physically present:

Ald. Goehl, Entrup, Bergman, Bauer, Ernst, Havermale, Farha, Sassen, Rein, VanCamp, Reis, Heinecke, Holtschlag. 13.

Absent: Ald. Lepper. 1.

Ald. Rein moved Alderman Lepper be excused from this meeting. Motion carried.

The minutes of the regular meeting of the City Council held June 25, 2018, were approved as printed on a motion of Ald. Havermale. Motion carried.

Legal Counsel: Assistant Corporation Counsel Bruce Alford.

The City Clerk presented and read the following:

PETITIONS

By the District requesting permission to close Hampshire St. from 6th to 7th from noon to 10:00 p.m. to hold the annual Feast Community Dinner on August 5th and to waive Section 111.096 (a) (Consumption and Possession of Alcoholic Liquor on Public Streets, Alleys, and Sidewalks and Lots). Barricades needed.

Ald. Holtschlag moved the prayer of the petition be granted and the proper authorities notified. Motion carried.

By the Early Tin Dusters Street Rod Club requesting permission to close the following streets and parking lots from 5:00 p.m. on Friday, October 19th, to 5:00 p.m. on Saturday, October 20th, for the display of street rods and activities during the “Annual Early Tin Duster Fall Color Run”: Maine, 4th to 8th; Hampshire, 4th to 8th; 5th, Vermont to Jersey; 6th, Vermont to Jersey; 7th, Vermont to Jersey; and Parking Lots F, G, I and City Hall Parking Lot. Barricades needed.

Ald. Holtschlag moved the prayer of the petition be granted and the proper authorities notified. Motion carried.

REPORTS OF THE QUINCY PLAN COMMISSION

Recommending approval of the zoning changes from RU1 (Rural) to M1 (Light Industrial) for properties at 100 N. 63rd and the unaddressed 3.78-acre parcel adjacent on the north.

Ald. Havermale moved the report be received and concurred in and an ordinance drafted. Motion carried. Recommending approval of a re-subdivision of part of Lot 8 and Lot 9 in Prairie Crossing Subdivision.

Ald. Ernst moved the report be received and concurred in. Motion carried.

Recommending approval of an amendment to a special permit for a planned development for automobile service and package liquor sales, to also include liquor sales by the drink and gaming at 1705 Harrison zoned C1B.

Request to Speak

Written request to speak under suspended rules by Donald Heck, 608 Vermont, concerning the planned development at 1705 Harrison.

Rules Suspended

Ald. Sassen moved the rules be suspended at this time to hear from the above individual. Motion carried.

Donald Heck, 608 Vermont, stated he was here to answer questions. Speaking on behalf of the owner, this is not going to be a tavern. The Gaming Commission requires establishments to sell liquor by the drink in order to be considered for a gaming license.

Ald. Reis moved the rules be resumed. Motion carried.

Ald. Reis moved the report be received and concurred in and an ordinance drafted. Motion carried.

Recommending approval of a special permit to allow a nightclub on property at 124 North 5th, subject to the following three conditions:

(1) Correction of deficiencies specified in the Director of Enforcement and Inspection’s Notice to Responsible Party dated June 11, 2018.

(2) Nightclub management shall ensure that the nightclub property and all areas within 200 feet of the nightclub are free of any waste or litter generated by the nightclub by 6:00 a.m. following each night of operation. (3) City Council authorization of the use of Parking Lot G by nightclub patrons.

Requests to Speak

Written requests to speak under suspended rules by Austin Young, 234 1⁄2 N. 12th, Christopher Taylor, 1005 Kentucky and Rusty Williams, 117 N. 4th, Unit 1, in support of 124 N. 5th and Bret Austin, 214 1⁄2 N. 6th.

Rules Suspended

Ald. Holtschlag moved the rules be suspended at this time to hear from the above individuals. Motion carried.

Austin Young, 234 1⁄2 N. 12th, asked the council to vote yes on the recommendation of the Plan Commission. This is an open historic place for the LBGT Community in downtown Quincy.

Christopher Taylor, 1005 Kentucky, a business owner, tenant, and gay stated his community needs this type of safe establishments for our patrons. He stated they would no longer use the rear door for entry. Security would be in place. They would see that the area was clear of trash each night. Outside noise should be minimal. At a later date, the upstairs would be re-done. He also addressed the concerns of the stability of the building.

Rusty Williams, 117 N. 4th, Unit 1, stated he is 100 % for this night club. He felt Washington Park Community needs to stand together and show diversity. He knows it will bring business to his establishment too. He will be backing this night club.

Bret Austin, 214 1⁄2 N. 6th, stated he owns property close to this area. His issue comes down to usage. He knows there are building issues and he would like to see the project paused until the issues are addressed. He stated no matter what this building is used for it has problems. He asked about the noise and parking issues. He stated that because of the smoking ban of several years ago, this drives patrons outside and when you have a place that has no surrounding property or a place for a beer garden, that can become a problem, but may be workable. Because of the needed fundamental building repairs, he asked if they could pause this until structural plans have come out. He believes in this group and supports development in a better location. He agreed with Ald. Rein that maybe they should run this as a tavern for three or four months to prove themselves and then ask for a nightclub license.

Ald. Holtschlag moved the rules be resumed. Motion carried.

Ald. Holtschlag moved to deny the request, seconded by Ald. Rein, and on the roll call the following vote resulted: Yeas: Ald. Rein, VanCamp, Heinecke, Holtschlag, Goehl, Bergman, Bauer, Ernst. 8. Nays: Ald. Reis, Entrup, Havermale, Farha, Sassen. 5. Absent: Ald. Lepper. 1. Motion carried.

MONTHLY REPORTS

The monthly reports of the City Clerk, the City Treasurer, and the City Comptroller for the month of June, 2018, and the Mosquito Abatement Program, the Forestry Division, the Street Cleaning Dept., the Recycling Division, the Street & Paint Division and the Quincy Police Department for the month of May, 2018, were ordered received and filed on a motion of Ald. Sassen. Motion carried.

ANNUAL REPORT OF THE QUINCY POLICE DEPARTMENT

The annual report of the Quincy Police Department for the fiscal year ending April 30, 2018, was ordered received and filed on a motion of Ald. Havermale. Motion carried.

PUBLIC FORUM

Rocky Murry, 210 Maiden Lane, speaking on city services stating he pays his taxes on time using city services. He had moved to a new home and has had constant trouble with getting his garbage and recycling picked up. He asked the question “If I go to my Alderman and Alderwoman and can’t get this resolved, who do I go to now?”

Jeff Kerkhoff, 1221 Spruce, regarding “Born on the 4th of July, the importance of President Calvin Coolidge” plus related topics. He also had a handout for the City Council.

NOTICE OR PREHEARING CONFERENCE

Notice of Prehearing Conference by the Illinois Commerce Commission on its own motion vs. Ameren Illinois Co. d/b/a Ameren Illinois on petition pursuant to Rider QIP of schedule of rates for gas service to initiate a proceeding to determine the accuracy and prudence of qualifying infrastructure investment in the office of the Commission, Springfield, IL on July 18th at 9:00 a.m.

Ald. Havermale moved the notice be referred to the Legal Department. Motion carried.

Notice of Prehearing Conference by the Illinois Commerce Commission on its own motion vs. Ameren Illinois Co. d/b/a Ameren Illinois on reconciliation of revenues collected under rider GER with the actual costs associated with natural gas energy efficiency plans in the office of the Commission, Springfield, IL on July 18th at 9:30 a.m.

Ald. Havermale moved the notice be referred to the Legal Department. Motion carried.

MAYOR’S APPOINTMENT

By Mayor Kyle A. Moore making the appointment of Trenton Murfin to the Sister City Commission. Ald. Sassen moved the appointment be confirmed. Motion carried.

RESOLUTION

WHEREAS, the City of Quincy has been offered a grant by the State of Illinois to assist with funding for the conversion to a groundwater supply for its water supply source; and,

WHEREAS, the City of Quincy has had an interest in the conversion of its water supply source for many years and has done a previous study and test drilling to determine the feasibility and cost of this type of project; and,

WHEREAS, the grant offered by the State of Illinois will provide three (3) million dollars towards the conversion of the water supply thus substantially reducing the City’s capital investment in the proposed project; and,

WHEREAS, the City desires to perform the drilling of up to four (4) test wells and obtain an estimate of cost for the drilling of a well and construction of a transmission line prior to committing funds to such a project; and,

WHEREAS, the team of Ranney Collector Wells of Columbus, Ohio, and Klingner and Associates of Quincy, Illinois, are the firms that provided these services for the 1980 study and are qualified and available to perform these services under Section 44.057 of the Municipal Code of the City of Quincy; and,

WHEREAS, funding for these services is available in the 2018/2019 fiscal year budget; now,

THEREFORE BE IT RESOLVED, that the Director of Utilities and Engineering and the Utilities Committee recom- mend to the Mayor and Quincy City Council that the City contract with Ranney Collector Wells of Columbus, Ohio, and Klingner and Associates of Quincy, Illinois, for an amount not to exceed $200,000 for the drilling of up to four (4) test wells and study to determine the cost for the drilling of a well and construction of a transmission line for the proposed conversion of its water supply source.

Ald. Bauer moved for the adoption of the resolution, seconded by Ald. Goehl, and on the roll call each of the 13 Aldermen voted yea, with 1 absent. Motion carried.

RESOLUTION

WHEREAS, the provision and improvement of public transportation facilities is essential to the development of a safe, efficient, functional public transportation system, and

WHEREAS, the Illinois Department of Transportation has the authority to make such Grants and makes funds available to offset certain capital costs of private non-profit, general public transportation system or an IDOT certified public provider transportation system providing specialized paratransit service; and

WHEREAS, Grants for said funds will impose certain obligations upon the recipient.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BOARD OF THE CITY OF QUINCY

Section 1. That an application be made to the Division of Public and Intermodal Transportation, Department of Transportation, State of Illinois, for a financial assistance grant under the Illinois Department of Transportation’s general authority to make such Grants, for the purpose of offsetting certain public transportation capital costs of Quincy Transit Lines.

Section 2. That the Mayor of the City of Quincy is hereby authorized and directed to execute and file on behalf of the Quincy Transit Lines such application.

Section 3. That the Mayor of the City of Quincy is authorized to furnish such additional information as may be required by the Division of Public and Intermodal Transportation in connection with the aforesaid application for said Grant.

Section 4. That the Mayor of the City of Quincy is hereby authorized and directed to execute and file on behalf of Quincy Transit Lines all required Grant Agreements with the Illinois Department of Transportation.

Adoption of an ordinance entitled: An Ordinance Amending Chapter 42 (Administrative Provisions Relating To The City) Of The Municipal Code Of The City Of Quincy. (Cleaning up language regarding Employee contribution for health insurance.)

Ald. Holtschlag moved the adoption of the ordinance, seconded by Ald. Entrup, and on a roll call each of the 13 Aldermen voted yea, with 1 absent.

The Chair, Mayor Kyle A. Moore, declared the motion carried and the ordinance adopted.

Second presentation of an ordinance entitled: An Ordinance Granting A Variation From Zoning Regulations. (4800 Maine, allow the number of ground-mounted signs to be increased from 1 sign to 3 signs, and to allow the areas of the ground-mounted signs to be increased from 32 sq. ft. to 48 sq. ft. for two signs, and from 32 sq. ft. to 105 sq. ft. for a third sign.)

Ald. Sassen moved the ordinance be read by its title, seconded by Ald. Bergman. Motion carried. The City Clerk read the ordinance by its title.

First presentation of an ordinance entitled: An Ordinance Amending Title IX (General Regulations) Of Chapter 90 (Animals) Of The Municipal Code Of The City Of Quincy Of 2015. (Animals running at large.)

Ald. Rein moved to refer the ordinance to the Police Aldermanic Committee for review, seconded by Ald. Sassen. Motion carried.

ORDINANCE

First presentation of an ordinance entitled: An Ordinance Amending Title IX (General Regulations) Of Chapter 90 (Animals) Of The Municipal Code Of The City Of Quincy Of 2015. (Dangerous and Vicious dogs.)

Ald. Rein moved to refer the ordinance to the Police Aldermanic Committee for review, seconded by Ald. Sassen. Motion carried.

Ald. Farha, seconded by Ald. Sassen, moved the reports be received and vouchers be issued for the various amounts and on the roll call each of the 13 Aldermen voted yea, with 1 absent. Motion carried.

MOTION

Ald. VanCamp moved to allow a dumpster on City right-of-way at 709 South 13th starting July 3rd for two weeks. Motion carried.

The City Council adjourned at 8:10 p.m. on a motion of Ald. Havermale. Motion carried.
