City of Quincy City Council met Jan. 6.

Here is the minutes provided by the council:

The regular meeting of the City Council was held this day at 7:00 p.m. with Mayor Kyle A. Moore presiding.

The following members were present:

Ald. McKiernan, Entrup, Bergman, Bauer, Finney, Farha, Rein, Mast, Reis, Awerkamp, Uzelac. 11.

Absent: Ald. Ernst, Sassen, Holtschlag. 3.

Ald. Farha moved the absent Aldermen be excused from this meeting. Motion carried.

The minutes of the regular meeting of the City Council held December 30, 2019, were approved as printed on a motion of Ald. Mast. Motion carried.

Legal Counsel: Corporation Counsel Lonnie Dunn.

The Deputy City Clerk presented and read the following:

PETITION

By the Quincy Exchange Club requesting permission to hold the 30th Annual Gus Macker 3 on 3 Basketball Tournament on May 23rd and 24th in the uptown Quincy area and closing the following streets from 5:00 p.m. Friday, May 22nd to 8:00 p.m. Sunday, May 24th; 5th Street, York to Hampshire; Jersey, Maine, Hampshire, 4th to 6th. “No Parking” signs will be posted on the above closed streets. They ask the police department be given authority to tow vehicles parked in the restricted areas from 6:00 a.m. May 23rd throughout the tournament.

Ald. Uzelac moved the petition be tabled for one week. Motion carried.

MONTHLY REPORTS

The monthly reports of the City Clerk, the City Treasurer and the City Comptroller for the month of December, 2019, and the Forestry Division, the Street Cleaning Dept., the Sign & Paint Division and Recycling Division and the Quincy Police Department for the month of November, 2019, were ordered received and filed on a motion of Ald. Farha. Motion carried.

PUBLIC FORUM

Joseph Principe, 517 N 27th, spoke concerning the Chamber of Commerce’s diversity and inclusion award and discrimination. He was opposed to the new owner of The Cab receiving the award and not honoring the previous owner.

Jeff Kerkhoff, 1221 Spruce, spoke concerning the 228th Anniversary of the ratification of the Bill of Rights plus related

topics. He had a handout for City Council.

MAYOR’S APPOINTMENTS

By Mayor Kyle A. Moore making the appointments of Ald. Tonia McKiernan, Ald. John Mast and Rick Ehrhart as City representatives to the Riverfront Master Plan Committee.

Ald. Entrup moved the appointments be confirmed. Motion carried.

RESOLUTION

WHEREAS, the City of Quincy engaged Azavar Government Solutions to perform a tax audit beginning in September 2018; and,

WHEREAS, Azavar Government Solutions has completed the tax audit of franchise fees paid by Comcast; and,

WHEREAS, Azavar Government Solutions and Comcast have identified certain sources of revenue generated by Comcast that were wrongly excluded from the definition of “gross revenue” as defined in the franchise agreement; and,

WHEREAS, Comcast has corrected customer address information to accurately reflect the franchise fee remitted to the City; and

WHEREAS, the parties have entered into a resolution in accordance with the Cable Act (47 USC 521 et. Seq.) and Illinois Municipal Code, including without limitation 65 ILCS 5/11-42-11 and the Illinois Constitution of 1970; and

WHEREAS, Comcast has proposed a settlement of $65,096.48, which the City of Quincy and Azavar Government Solutions believe to be a fair resolution;

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council authorize the City Treasurer to sign and accept the settlement, as proposed, for all franchise fees incurred through June 30, 2019.

Ald. Farha moved for the adoption of the resolution, seconded by Ald. Reis, and on the roll call each of the 11 Aldermen voted yea, with 3 absent. Motion carried.

ORDINANCE

Second presentation of an ordinance entitled: An Ordinance Granting A Special Use Permit For A Planned Development. (Allow 13 apartments and four event spaces at 2040 Cherry St., former Dewey School property.)

Ald. Bauer moved the requirements of Section 32.31 of the City Code of the City of Quincy be waived and the ordinance adopted, seconded by Ald. Reis, and on the roll call each of the 11 Aldermen voted yea, with 3 absent.

The Chair, Mayor Kyle A. Moore, declared the motion carried and the ordinance adopted.

Ald. Farha, seconded by Ald. Rein, moved the reports be received and vouchers be issued for the various amounts and on the roll call each of the 11 Aldermen voted yea, with 3 absent. Motion carried.

MOTION

Ald. Bauer moved to allow a dumpster on city right-of-way at 526 Elm starting January 7th for two weeks. Motion carried.

The City Council adjourned at 7:22 p.m. on a motion of Ald. Reis. Motion carried.
