City

City of Quincy City Council met Sept. 3.

Here is the minutes provided by the council:

Monday, September 2, 2019, being a holiday the regular meeting of the City Council was held this day at 7:00 p.m. with Mayor Kyle A. Moore presiding.

The following members were present:

Ald. McKiernan, Entrup, Bergman, Bauer, Finney, Ernst, Farha, Sassen, Rein, Mast, Reis, Awerkamp, Uzelac, Holtschlag. 14.

The minutes of the regular meeting of the City Council held August 26, 2019, were approved as printed on a motion of Ald. Ernst. Motion carried.

Legal Counsel: Corporation Counsel Bruce Alford.

The Deputy City Clerk presented and read the following:

PETITIONS

By the Quincy Rotary Club requesting permission to close York Street, 9th to 11th, 10th Street, Jersey to York, and 9th Street, Kentucky to York, on October 12th from noon to 10:00 p.m. for the annual Rotary “Oktoberfest”. They are requesting permission to waive Section 111.096 (a) (Consumption and Possession of Alcoholic Liquor on Public Streets, Alleys, and Sidewalks and Lots), 111.096(d) (Permitting Open liquor to leave licensed premises), 111.067(a) (Selling outside licensed building).

Ald. Holtschlag moved the prayer of the petition be granted and the proper authorities notified. Motion carried.

By the Knights of Columbus requesting permission to hold their annual “Tootsie Roll” tag days for People with Intellectual Disabilities September 27th & 28th at various locations in the city.

Ald. Sassen moved the prayer of the petition be granted and the proper authorities notified. Motion carried.

By On The Rail, 129 S. 4th, requesting to have live music in the patio on Saturday, September 14th from 7:00 p.m. to 10:00 p.m. or 8:00 p.m. to 11:00 p.m. The Quincy Police Department recommends approval with the time being 7:00 p.m. to 10:00 p.m.

Ald. Uzelac moved the prayer of the petition be granted with the Quincy Police Departments recommendation of 7:00 p.m. to 10:00 p.m. and the proper authorities notified. Motion carried.

By On The Rail, 129 S. 4th, requesting permission to waive Section 111.096 (a) (Consumption and Possession of Alcoholic Liquor on Public Streets, Alleys, and Sidewalks and Lots), Section 111.096 (d) (Permitting open liquor to leave licensed premises), Section 111.067(a) (Selling outside of Licensed Premises) on October 12th from noon to 7:00 p.m. for a Bags Tournament with proper licenses being obtained. They are also requesting to use the patio and block the north alley. There will be a fenced in area with only one way in and out. The Quincy Police Department denies this request citing that the business has already held 2 events on public property this year.

Ald. Holtschlag moved to override the Quincy Police Department’s recommendation to deny and moved the prayer of the petition be granted and the proper authorities notified. On a voice vote the Mayor declared the motion failed.

By The District requesting permission to temporarily close 5th and Maine for a 5K walk fundraiser on October 26th for the “Pink Pass It On In The District” walk to benefit Blessing Hospital’s Breast Center. Walkers will assemble at 8:30 a.m. at 5th & Maine St. The walk will start at 10:00 a.m. proceed from 5th & Maine to 12th, continue on the sidewalk to 24th, turn around walking on sidewalk back to 5th & Maine. They request police or auxiliary officers to assist at the intersections.

Ald. Sassen moved the prayer of the petition be granted and the proper authorities notified. Motion carried.

By Quincy Senior High School Student Council requesting permission to hold their Homecoming Parade on October 3rd beginning at 6:00 p.m. starting at 28th and Maine going east on Maine to Flinn Stadium. They are also requesting to close Maine from 24th to 27th and 25th from Maine to Hampshire beginning at 5:00 p.m. for lineup of floats and to post “No Parking” signs on both sides of Maine St. beginning at 1:30 p.m.

Ald. Sassen moved the prayer of the petition be granted and the proper authorities notified. Motion carried.

By City of Quincy/United Way requesting to conduct a raffle and have the bond requirement waived from now until 10/11/19. The City Clerk recommends approval of this permit.

MONTHLY REPORTS

The monthly reports of the City Clerk, the City Treasurer and the City Comptroller for the month of August, 2019, and the Quincy Police Department for the month of July, 2019, were ordered received and filed on a motion of Ald. Sassen. Motion carried.

REPORT OF THE QUINCY PLAN COMMISSION

Recommending approval of the one-lot subdivision of property located at 2124 North 24th, to be known as Wright’s Subdivision, under the “small tracts” provision of the subdivision ordinance.

Ald. Ernst moved the report be received and concurred in. Motion carried.

PUBLIC FORUM

Jeff Kerkhoff, 1221 Spruce, on the 232nd Anniversary of the signing of the Constitution plus related matters. He had a handout for the City Council.

RESOLUTION

WHEREAS, the State of Illinois acting through its Department of Transportation offers grants through the Federal Highway Administration’s Emergency Relief Program to assist municipalities with the repair of damages caused by natural disasters and catastrophic failures from external causes; and,

WHEREAS, recent historic flooding caused the failure of a section of storm sewer and collapse of roadway on Bonans- inga Drive; and,

WHEREAS, Bonansinga Drive is a Federal Aid road and the repair project for the flood damage meets the requirements of the Federal Highway Administration’s Emergency Relief Program; and,

WHEREAS, the City of Quincy has been awarded a grant for an amount not to exceed $293,388.00 for the repairs of the flood damage; and,

WHEREAS, the State of Illinois requires that the City of Quincy enter into an intergovernmental agreement for its par- ticipation in this program; now,

THEREFORE BE IT RESOLVED, that the Director of Utilities and Engineering recommends that the Mayor, on behalf of the City of Quincy, be authorized to enter into an agreement with the Illinois Department of Transportation for the award of funds through the State of Illinois Federal Highway Administration’s Emergency Relief Program for an amount not to exceed $293,388.00.

Ald. Bauer moved for the adoption of the resolution, seconded by Ald. Finney, and on the roll call each of the 14 Aldermen voted yea. Motion carried.

RESOLUTION

WHEREAS, the Department of Utilities and Engineering recently advertised for bids for the replacement of storm sew- er and roadway on Bonansinga Drive that was damaged by recent flooding; and,

WHEREAS, the following bids were received:

Rees Construction Company

Quincy, Illinois $307,143.00

Laverdiere Construction

Macomb, Illinois $265,376.00

Engineer’s Estimate $127,883.00

WHEREAS, the bids have been reviewed by the Director of Utilities and Engineering and found to be acceptable; and

WHEREAS, to allow for the uninterrupted progression of this project in the event that changes or modifications are required, an additional 10% over the amount of the bid shall be included in the encumbrance for this project; and, 

WHEREAS, funding for this project is available in the 2019/2020 fiscal year Sewer Fund budget; and,

WHEREAS, the repair project meets the requirements of the State of Illinois Federal Highway Administration’s Emergency Relief Program for Federal-aid highways and the City of Quincy will be reimbursed for the full cost of this project; now,

THEREFORE BE IT RESOLVED, that the Director of Utilities and Engineering and the Central Services Committee recommend to the Mayor and Quincy City Council that the bid from Laverdiere Construction of Macomb, Illinois, in the amount of $265,376.00 be accepted and that the Mayor be authorized to sign the necessary contract documents. Ald. Sassen moved for the adoption of the resolution, seconded by Ald. Farha, and on the roll call each of the 14 Aldermen voted yea. Motion carried.

RESOLUTION

WHEREAS, on January 24, 2011, the Quincy City Council approved a ten (10) year extension of the electricity fran- chise agreement between the City of Quincy and Ameren Illinois; and,

WHEREAS, the franchise agreement requires approval for the removal or addition of non-metered street light services; and,

WHEREAS, the City requires the following changes be made to the agreement: Delete - one (1) LED 10 Type IV at the NE corner of 4th and York

Delete - one (1) 100W HID at the SW corner of 14th and Maine

Delete - one (1) 100W HID at the SE corner of 30th and Broadway

Delete - four (4) 250W HID on the north side of Vermont, 14th-16th

Delete - two (2) 400W HID on the north side of Vermont, 14th-16th

NOW THEREFORE BE IT RESOLVED, that the Director of Utilities and Engineering recommends to the Mayor and Quincy City Council that the franchise agreement be amended and that Ameren Illinois be notified to adopt these changes. Jeffrey Conte, P.E.

ORDINANCE

Adoption of an ordinance entitled: An Ordinance, Creating Section 154.10, Chapter 154, Of The City Code Of Quincy To Be Entitled, “Registration of Foreclosure Mortgages And Vacant Property”. (Foreclosure and vacant property)

Ald. Uzelac moved the adoption of the ordinance, seconded by Ald. Entrup, and on a roll call each of the 14 Aldermen voted yea.

The Chair, Mayor Kyle A. Moore, declared the motion carried and the ordinance adopted.

ORDINANCE

Adoption of an ordinance entitled: An Ordinance Amending Title XI (Business Regulations) Of Chapter 111 (Alcohol Liquor Dealer) And Chapter 112 (Amusements) Of The Municipal Code Of The City Of Quincy of 2015. (Live Music)

Ald. Rein moved the adoption of the ordinance, seconded by Ald. Reis, and on a roll call each of the 14 Aldermen voted yea.

The Chair, Mayor Kyle A. Moore, declared the motion carried and the ordinance adopted.

ORDINANCE

First presentation of an ordinance entitled: An Ordinance Amending Chapter 162 (Zoning Regulations) Of The Municipal Code Of The City Of Quincy (2015) Pertaining To Adult – Use Cannabis. (Regulate adult-use cannabis business establishments.)

Requests to Speak

Written requests to speak under suspended rules by Randy Shover, Executive Director, and Jeff Steinkamp, Board Chairman, of Addicts Victorious Ministries, 224 S. 8th, speaking in opposition to the adult use cannabis ordinance and Scott Miller, Green Thumb Industries Inc., 3104 N Main St., Canton IL, concerning the adult use cannabis ordinance.

Rules Suspended

Ald. Ernst moved the rules be suspended at this time to hear from the above individuals. Motion carried.

Randy Shover, Executive Director, Addicts Victorious Ministries, 224 S. 8th, stated that the council is in a lose-lose situation. He can tell from AVM’s experience that marijuana is a “Gate Way Drug”. Many people that they see are a product of their parents using the drug. It causes the deterioration of the family unit. He stated that the council won’t be able stop the use, but can slow it down and urges them to vote no.

Jeff Steinkamp, Board Chairman, of Addicts Victorious Ministries, 224 S. 8th, stated that he concurs with Mr. Shover. Of all the addicts that they counsel, every one of them started with using marijuana. He urged the council to read the document he emailed to them called “Lessons Learned from Marijuana Legalization in Four U.S. States and D.C.” This document is not meant to be pro or con, it just states the facts. He urges the council to do the right thing and vote no.

Scott Miller, general manager of Green Thumb Industries Inc., 3104 N Main St., Canton IL, stated Green Thumb is one of the largest marijuana companies in the United States and is interested in coming to Quincy and opening a dispensary. He stated that they are a community minded company. They would create about 15 full time jobs. The City has the ability to add a 3% City tax to sales.

Ald. Ernst moved the rules be resumed. Motion carried.

Ald. Holtschlag moved the ordinance be read by its title, seconded by Ald. Uzelac. Motion carried. The Deputy City Clerk read the ordinance by its title.

ORDINANCE

First presentation of an ordinance entitled: An Ordinance Amending The Municipal Code Of The Chapter Of Quincy Chapter 45, By The Addition Of Section 145 Imposing A Municipal Cannabis Retailers’ Occupation Tax.

Ald. Holtschlag moved the ordinance be read by its title, seconded by Ald. Uzelac. Motion carried. The Deputy City Clerk read the ordinance by its title.

Finance Committee

Ald. Farha, seconded by Ald. Sassen, moved the reports be received and vouchers be issued for the various amounts and on the roll call each of the 14 Aldermen voted yea. Motion carried.

MOTIONS

Ald. Sassen moved to permit a dumpster on city right-of-way at 1228 Vermont for 2 weeks. Motion carried.

Ald. Holtschlag moved to allow Blessed Sacrament to close the alley between 7th to 8th Street, Adams and Monroe for their “Septemberfest” on September 7th from 8:00 a.m. to midnight. Barricades needed. Motion carried.

Ald. Holtschlag moved to refer to the Traffic Commission that the school bus drivers would like to have “No Parking” on the west side of 14th Street between Jersey and Park Place. Motion carried.

The City Council adjourned at 7:41 p.m. on a motion of Ald. Ernst. Motion carried.
